Pada 30hb Oktober 2015, Kabinet telah mengeluarkan keputusan untuk tidak mengharamkan rokok elektronik dan vape. Namun begitu, cecair elektronik (e-liquid) yang mengandungi nikotin dan lain-lain bahan di bawah Jadual Racun (http://www.pharmacy.gov.my/v2/sites/default/files/document-upload/poisons-list-04.02.2015_1.pdf) adalah dikawal di bawah Akta Racun 1952 dan Akta Dadah Berbahaya 1952.
Cecair elektronik (e-liquid) yang mengandungi nikotin dikehendaki didaftarkan di bawah Peraturan-peraturan Kawalan Dadah dan Kosmetik 1984, Akta Jualan Dadah 1952. Ia hanya boleh dijual oleh ahli Farmasi yang berlesen dan Pengamal Perubatan yang berdaftar dan perlu direkodkan. Mengikut Akta Racun 1952, penjualan nikotin oleh lain-lain pihak adalah salah di sisi undang-undang.
REGULATION OF SALES AND USE OF ELECTRONIC CIGARETTE AND VAPE
BY THE MINISTRY OF HEALTH
On the 30th October 2015, the Cabinet has made a decision not to ban electronic cigarette and vape. However, the e-liquid containing nicotine and other subtances listed under the Poisons List (http://www.pharmacy.gov.my/v2/sites/default/files/document-upload/poisons-list-04.02.2015_1.pdf) are highly regulated under the Poisons Act 1952 and the Dangerous Drugs Act 1952.
E-liquid containing nicotine is required to be registered under the Control of Drugs and Cosmetics Regulation 1984, Sale of Drugs Act 1952. It can only be supplied by licensed Pharmacists and registered Medical Practitioners and has to be recorded. According to the Poisons Act 1952, the sale of nicotine by other parties is unlawful.
